Ok, so I’m a drug, alcohol, and tobacco addict wanting disability SSI and SSDI benefits, so what right?
- A claimant will not be considered to be disabled if alcoholism or drug addiction would be a contributing factor material to the Commissioner’s determination that the individual is disabled/ 223(d)(2)(C) and 1614(a)(3)(J).
- Ok so what about tobacco right? If you are claiming COPD, or some lung related issue, the ALJ may be less likely to find you disabled, if you have not learned your lesson, and stopped smoking.
